Members present:
Chair Neal Carpenter, NC; Joe Strauch, JS; Tim Flanagan, TF; Vince Ammendola, VA; Rose Fitzgerald Casey, RFC; David Lane, DL; Dick Ferren, DF

RDA filed by Craig Kirby for property located at 76 Dunmore Ct., Map 8 Parcel 6-48.  The proposed project is for the construction of a 12 foot by 16 foot deck.

Presenting the RDA was Matthew Puntin of SK Design Group.

There was a site visit on October 28th at 5:30 pm.  TF, VA, and NC attended with Mr. Puntin.

NC told Mr. Puntin that the wetland delineation is only approved in work area that is flagged A-1 through A-8.  

VA made a motion to issue a Negative 3 determination with the condition that the wetland delineation is only approved in work area that is flagged A-1 through A-8.  JS seconded the motion and the motion carried 7-0.
Ray Grogan and Kevin Sprague were present.

Requests for Determination of Applicability
Three requests for three RDAs were filed by the Town of Lenox.  All were presented by Jeff Vincent, Superintendent of the Department of Public Works, who stated that the proposed projects are to install a flexible pond leveler device to control the water level behind beaver dam.
Each RDA was presented separately and voted on separately.

In attendance were two citizens.  They were Kevin Sprague and Ray Grogan.   

1.      For property located at Laurel Lake Rd., Map 1 Parcel 5.  
VA made a motion to issue a Negative 2 Determination.   RF seconded the motion and the motion carried 7-0.

2.      For property located at West St., Map 11 Parcel 10.  
VA made a motion to issue a Negative 2 Determination and DF seconded the motion.  The motion carried 7-0.

3.      For property located at West Mountain Rd., Map 21 Parcel 1.  
JS made a motion to issue a Negative 2 Determination and TF seconded the motion.  The motion carried 7-0.

Minutes:
·       September 17, 2009 RF made a motion to approve the minutes and TF seconded the motion.  The motion carried by a vote of 7-0.  
·       October 15, 2009 –JS made a motion to approve the minutes and VA seconded.  The motion carried by a vote of 5-0-2 with DL and DF abstaining as they were not at that meeting.

RF made a motion to adjourn at 8:15 pm. VA seconded the motion and the motion carried 7-0.
